Terms of Service

By accessing or using the NovaMart platform (website, mobile browser, or any associated service), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the platform.

Age requirement

You must be at least 18 years old, or have parental/guardian consent, to create an account or place an order on NovaMart.

Account responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

Accuracy

We strive to ensure that all product descriptions, images, and prices are accurate. However, errors may occur. In the event of a pricing error, we reserve the right to cancel the affected order and issue a full refund.

Availability

Product availability is subject to change without notice. If an item becomes unavailable after your order is placed, we will notify you and issue a full refund for that item.

Prices

All prices are displayed in Bangladeshi Taka (BDT) and are inclusive of applicable taxes unless stated otherwise. Shipping costs are shown separately at checkout.

Order confirmation

An order is not confirmed until you receive an order confirmation message. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud.

Payment

By providing payment information, you represent that you are authorised to use the payment method. All digital transactions are processed through our payment gateway and are subject to its terms.

Cancellation

You may cancel an order within 12 hours of placement, provided it has not yet been dispatched. After dispatch, cancellations are not possible — please refer to our Returns Policy.

Delivery timelines are estimates only and are not guaranteed. NovaMart is not liable for delays caused by circumstances outside our control, including courier failures, natural disasters, or public holidays. Refer to our Shipping & Delivery Policy for full details.

Returns and refunds are governed by our Returns & Refunds Policy, which is incorporated into these Terms by reference. By placing an order, you agree to the terms of that policy.

You agree not to: use the platform for any unlawful purpose; submit false or misleading information; attempt to gain unauthorised access to any part of the platform; scrape, crawl, or data-mine the platform without prior written consent; or interfere with the security or integrity of the platform.

All content on the NovaMart platform — including logos, text, images, and software — is the property of NovaMart or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

To the fullest extent permitted by law, NovaMart shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any products purchased through it. Our total liability for any claim arising from a specific order shall not exceed the value of that order.

We may update these Terms of Service at any time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of the platform after any changes constitutes your acceptance of the new terms.

These Terms are governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
